Teacher Policy

This Teacher Policy applies to you if you provide (or intend to provide) Teacher Services or Classes on LEARN Anytime Anywhere. You are required to read this Teacher Policy carefully and agree to it, as it contains the policies and terms you must adhere to use LEARN Anytime Anywhere to provide your services. Unless defined under this Teacher Policy, any capitalised term will have the meanings provided to them under our general Terms and Conditions.  

 

If you do not agree to this Teacher Policy, you do not have our permission to provide Teacher Services or sell Classes on the Site. Likewise, we are not obligated to provide you with any benefits for the Classes you sell through the Site.

 

We reserve the right to update this Teacher Policy from time to time. Updates to this Teacher Policy will be posted on this page, and such updates will take effect immediately it is posted. We may or may not notify you of any updates to this Teacher Policy. If we decide to notify you of any updates to this Teacher Policy, such notification will be given via your Teacher Account associated email address. Nevertheless, you are required to review this Teacher Policy from time-to-time to be updated about any changes to it. By your continued use of the Site to sell Classes or provide Teacher Services after any updates to this Teacher Policy, you warrant to us that you have agreed to such update.

 

This Teacher Policy is designed to encourage the highest standards of Teacher behaviour in their relationships with Students by setting clear expectations, and to provide the principles to guide Teachers in their daily conduct when providing Teacher Services and interacting with Students. However, our Teachers come from all over the world and are thus accustomed to a variety of different cultural norms. As a result, this Teacher Policy attempts to adopt universally accepted standards of respect and tolerance. This Teacher Policy does not attempt to address every potential situation that could arise when Teachers interact with Students on the Site. Instead, it provides principles for ethical and professional behaviour that can serve as guidance regarding LEARN Anytime Anywhere expectations.



1. Teacher Registration and Service Description

1.1 Teacher Registration

In order to provide Teacher Services or sell Classes as a teacher ("Teacher") on LEARN Anytime Anywhere, you must first submit a complete application together with a copy of your passport or other official identification card issued by the applicable government authorities of your location and an address proof within 3 months through the Site ("Teacher Application"). Your completed Teacher Application will be evaluated by LEARN Anytime Anywhere for approval. If your Teacher Application is approved, your user status will be changed to "Teacher", and you will have the ability to create and manage “Teacher’s Dashboard” on LEARN Anytime Anywhere. Then, you can begin providing Teacher Services, including offering and providing "Class/es" to “Students”.

 

There is an option for you to provide LEARN Anytime Anywhere background check reports from public records or through third-party vendors such as criminal convictions or sex offender registrations. This will serve as a bonus for Parents to enrol their children in your Class. You can upload such documents on your “Teacher’s Dashboard / Manage Profile / Badges” section.



1.2 Teacher Services Description

  1. As a Teacher, you must create a description of your Teacher Services when submitting your Teacher Application. When creating the description of your Teaching Services, you agree to:

    i.      Write a specific, detailed service description with clear teaching scope;

    ii.     Set expectations that you can meet;

    iii.   Stay away from description that is misleading or list services that are different from what the Students will get when you provide Teacher Services to them;

    iv.    Offer any Teacher Services in exchange for positive feedback or at no cost;

    v.     Refrain from advertising any third-party teaching services, website, application, software, platform or media; and

    vi.    Exclude any personal contact information, including without limitation, your phone number, email address, mail box, home address, social media page or any contact information which a Parent/Student or third party can use to contact you outside LEARN Anytime Anywhere.


2. Teacher Services Guidelines

2.1 Teacher Service Request

In order to provide Teacher Services or sell Classes to Parents/Students upon request, you agree to the following terms and conditions:


You agree to:

i.      Use the Site to manage and provide all Teacher Service requests from Parents/Students;

ii.     Respond promptly to all Teacher Services and Class-related communications, whether from a Parent/Student or LEARN Anytime Anywhere;

iii.   Maintain a record of all important details of the communication between you and the Parent/Student. For the avoidance of doubt, all communication regarding your use of LEARN Anytime Anywhere must be via the Site, and important details generally include information related to the scope of your Teacher Services.


2.2 Class Policy

You are required to comply with the below class policies when providing a Class through LEARN Anytime Anywhere: 

i.      Commit to your Class schedule: A confirmed Class is a commitment you make with a Parent/Student. You may only reschedule or cancel as a last resort and only after you have given prior notice to the Parent/Student.

ii.     Keep records: You are expected to keep records of all important communications that occurred between you and the Parents/Students. If there is a dispute between you or any Parent/Student, the communication between you and the Student/Parent will be relied upon by LEARN Anytime Anywhere to settle such dispute.

iii.   Provide a Class on time: You are required to commence a Class at the scheduled time, as communicated through the Site.

iv.    Waiting for a late Student: If a Student is late for a Class, you do not have to wait for the Student if there are other Students already in the class. However, should the late Student be the only Student enrolled in that Class, you should be available to start the Class at any time during the scheduled period for the Class. However, you are under no obligation to make up for any lost time or teach beyond the scheduled time due to the Student's late arrival.

v.     End Class on time: You should politely let your Students know that their Classes are ending by reminding them before the end of the Class period. You may politely tell the Student that you need to prepare for an upcoming Class with another/other Student/Students.

vi.    Rescheduling a Class due to a Student’s absence: If a Student fails to attend a Class and requests to reschedule the class, you may accept or reject at your discretion. You are not under any obligation to agree to the rescheduling request. You may refer to our Teacher's Guide for how to move a Student to another Class. For more information regarding this section, please, review our Code of Conduct and Class Policy document.


2.3 Cancellation and Rescheduling

If you are unable to provide your Teacher Services or a Class at the time previously agreed between you and any Parents/Students, you agree to: (i) immediately inform the Parent/Student that you are unable to provide your Teacher Services or the Class at the scheduled time, including providing reasonable explanation why you will be unable to provide your Teacher Services or the Class at the scheduled time; and (ii) immediately inform LEARN Anytime Anywhere customer service. If you were unable to inform the Parent/Student in advance due to an emergency, you are required to give an explanation to the Parent/Student as soon as you are able to do so.

 

After obtaining the consent from the Parent/Student, then, you may cancel or reschedule any scheduled Teacher Service or Class at any time that is more than 24 hours before such Teacher Service or Class is scheduled to start. Cancelling or rescheduling a Teacher Service or Class must be handled through the Site, and by following the processes laid out in our Teacher's Guide.

 

Except in the rare case of true emergencies, no Teacher Service or Class may be cancelled or rescheduled by a Teacher or Student within 24 hours of the start time for such Teacher Service.


2.4 Payment and Feedback

After you provide any Teacher Services or Class, you agree to the following:

i.      Use the LEARN Anytime Anywhere payment service (“Payout Service”) to handle all financial matters related to your Teacher Services or sale of Class; and

ii.    Provide helpful, objective, balanced feedback for the Student.


2.5 Additional Guidelines

You also agree to the following additional guidelines in connection with providing your Teacher Services or sale of Class on the Site:

i.      To maintain the privacy of the Students in accordance with our Privacy Policy, including refraining from requesting any personal information or data from Students, such as birth date, age, government-issued identification number, phone number or home address;

ii.     To maintain the privacy of your own personal information, including details related to your Payout Service setting;

iii.   To cooperate with LEARN Anytime Anywhere in any anti-fraud actions and in resolving any disputes; and

iv.    To report any violations of our Terms and Conditions or policies found on the Site, including the misuse of our ratings and feedback systems.


3. Service Standards

3.1 Be Culturally Sensitive

You are expected to respect the values and traditions of your Students. Unless specifically requested by any Student, please avoid asking about the following:

i.      Personal life: For example, do not ask a Student about the job of his/her parent or legal guardian.

ii.     Political affiliations: For example, do not ask a Student whether he/she supports a particular political party or ideological view.

iii.   Religious affiliations: For example, do not ask a Student if he/she believes in God or identifies with a particular religious group.


3.2 Be Patient and Polite

Since Students come from different backgrounds and have different language abilities, it is important to be patient and polite. Help them through their language learning difficulties. Be encouraging, not discouraging.

i.      Do‌ ‌not‌ ‌berate, ‌ ‌yell‌ ‌at ‌ ‌or‌ ‌insult‌ ‌a‌ ‌Student because of his/her inability to understand any topic qyickly.‌ ‌Do‌ ‌not‌ ‌tell‌ ‌a‌ ‌Student‌ ‌he‌/she‌ ‌is‌ ‌dumb‌ ‌or‌ ‌insult‌ ‌their‌ ‌current‌ ‌level‌ ‌of‌ ‌language‌ ‌ability.‌

ii.     Do‌ ‌not‌ ‌use‌ ‌rude‌ ‌or‌ ‌offensive‌ ‌language‌ ‌with‌ ‌a‌ ‌Student. ‌ ‌Instead, ‌ ‌use‌ ‌respectful‌ ‌language‌ ‌and‌ ‌speak‌ ‌to‌ ‌the Student‌ ‌with‌ ‌professional‌ ‌courtesy.

iii.   Do‌ ‌not‌ ‌lose‌ ‌your‌ ‌temper‌ ‌with‌ ‌a‌ ‌Student or scare them in a way that they may be pushed away from coming back to use LEARN Anytime Anywhere.  ‌

If‌ ‌you‌ ‌are‌ ‌not‌ ‌sure‌‌ ‌whether‌ ‌you‌ ‌are‌ ‌able‌ ‌to‌ ‌handle‌ ‌a‌ ‌situation‌ ‌with‌ ‌composure,‌ ‌you‌ ‌are‌ ‌welcome‌ ‌to‌ ‌contact‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌customer‌ ‌service‌ ‌for‌ ‌help,‌ ‌or‌ ‌to‌ ‌suggest‌ ‌that‌ ‌a‌ ‌Student‌ ‌contact‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌customer‌ ‌service‌ ‌to‌ ‌resolve‌ ‌an‌ ‌issue.‌ 


3.3‌ ‌Be‌ ‌Professional‌

You‌ ‌must‌ ‌take‌ ‌the‌ ‌initiative‌ ‌in‌ ‌communicating‌ ‌with‌ ‌and‌ ‌managing‌ your ‌Students. ‌In‌ ‌addition‌ ‌to‌ ‌the‌ ‌Teacher‌ ‌Services‌ ‌guidelines‌ ‌described‌ ‌in‌ ‌Section‌ ‌2‌ above ‌(Teacher‌ ‌Services‌ ‌Guidelines),‌ ‌Teachers‌ ‌are‌ ‌expected‌ ‌to‌ ‌provide‌ ‌Teacher‌ ‌Services‌ ‌in‌ ‌a‌ ‌professional‌ ‌manner,‌ ‌which‌ ‌includes:‌

i.      Being‌ ‌responsive:‌ ‌You‌ ‌should‌ ‌respond‌ ‌to‌ ‌messages‌ ‌from‌ ‌Parents/‌Students‌ promptly.‌ ‌When‌ ‌you‌ ‌receive‌ ‌a‌ ‌Teacher‌ ‌Service‌ ‌request‌ ‌from‌ ‌a‌ ‌Parent‌‌/Student,‌ ‌you‌ ‌should‌ ‌respond‌ ‌within‌ ‌48‌ ‌hours‌ ‌OR‌ ‌before‌ ‌the‌ ‌start‌ ‌time‌ ‌of‌ ‌the‌ ‌enrolled‌ ‌scheduled‌ ‌Class‌ ‌of‌ ‌the‌ ‌Student‌ ‌for‌ ‌the‌ ‌Teacher‌ ‌Service‌ ‌(whichever‌ ‌is‌ ‌sooner).‌ ‌The‌ Site ‌will‌ ‌send‌ ‌you‌ ‌notifications‌ ‌when‌ ‌a‌ ‌Parent‌/Student‌ ‌sends‌ ‌you‌ ‌a‌ ‌message.‌

ii.     Respect‌ ‌Student’s ‌privacy:‌ ‌The‌ ‌recording‌ ‌of‌ ‌your‌ ‌lesson‌ ‌should‌ ‌not‌ ‌include‌ ‌any‌ ‌of‌ ‌your‌ ‌Students‌ ‌but‌ ‌yourself.

iii.   Provide‌ ‌accurate‌ ‌and‌ ‌respectful‌ ‌feedback:‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌provides‌ ‌a‌ ‌feedback‌ ‌and‌ ‌rating‌ ‌system‌ ‌to‌ ‌allow‌ Parents/‌Students‌ ‌to‌ ‌express‌ ‌their‌ ‌opinions‌ ‌to‌ ‌their‌ ‌Teacher’s‌ ‌instruction‌ ‌quality publicly.‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌does‌ ‌not‌ ‌monitor,‌ ‌censor‌ ‌or‌ ‌investigate‌ ‌feedback‌ ‌and‌ ‌rating‌ ‌posts‌ ‌unless‌ ‌a‌ ‌problem‌ ‌is‌ ‌brought‌ ‌to‌ ‌our‌ ‌attention.‌ ‌If‌ ‌you‌ ‌believe‌ ‌a‌ ‌particular‌ ‌Student’s‌ ‌feedback‌ ‌or‌ ‌rating‌ ‌is‌ ‌improper,‌ ‌untrue‌ ‌or‌ ‌violates our Terms and Conditions‌ ‌or‌ ‌‌Policies,‌ ‌please‌ ‌report‌ ‌the‌ ‌incident‌ ‌to‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌customer‌ ‌service.‌



4.‌ ‌Violation‌ ‌of‌ ‌this‌ ‌Teacher‌ ‌Policy

You‌ ‌are‌ ‌expected‌ ‌to‌ ‌perform‌ ‌any‌ ‌Teacher‌ ‌Service‌ ‌in‌ ‌a‌ ‌manner‌ ‌that‌ ‌satisfies‌ ‌the‌ ‌teaching‌ ‌standards‌ ‌described‌ ‌above‌ ‌and‌ ‌results‌ ‌in‌ ‌a‌ ‌consistently‌ ‌high‌ ‌level‌ ‌of‌ ‌Student‌ ‌satisfaction. ‌‌You‌ will be deemed to be in ‌breach‌ ‌of‌ ‌this‌ ‌Teacher‌ ‌Policy ‌if‌ ‌you:

 

i.      Fail‌ ‌to‌ ‌deliver‌ ‌any‌ ‌Teacher‌ ‌Service‌ ‌for‌ ‌which‌ ‌Class is scheduled; ‌

ii.     Fail‌ ‌to‌ ‌take‌ ‌reasonable‌ ‌efforts‌ ‌to‌ ‌resolving‌ ‌a‌ ‌dispute‌ ‌with‌ ‌a‌ ‌Student; ‌

iii.   Create‌ ‌unacceptable‌ ‌levels‌ ‌of‌ ‌Student‌ ‌dissatisfaction; ‌ ‌or‌

iv.    Violate‌ ‌any‌ of our Terms and Conditions or ‌Policies.

LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌reserves‌ ‌the‌ ‌right‌ ‌to‌ ‌take‌ ‌any‌ ‌of‌ ‌the‌ ‌following‌ ‌actions‌ ‌at‌ ‌any‌ ‌time‌ ‌and‌ ‌in‌ ‌our‌ ‌sole‌ ‌discretion if you violate this Teacher Policy or our Terms and Conditions and other Policies:

i.      Cancel‌ ‌your‌ ‌listed‌ ‌Teacher‌ ‌Services; ‌

ii.     Limit‌ ‌your‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌Account‌ ‌privileges; ‌

iii.   Adjust‌ ‌your‌ ‌Teacher‌ ‌Payout‌ ‌balance‌ ‌and/or‌ ‌freeze‌ ‌or‌ ‌suspend‌ ‌your‌ ‌Teacher‌ ‌Payout‌ ‌settings;

iv.    Suspend‌ ‌or‌ ‌terminate‌ ‌your‌ Teacher account; ‌ ‌or‌

v.     Contact‌ ‌law‌ ‌enforcement‌ ‌or‌ ‌seek‌ ‌legal‌ ‌remedies. ‌



5.‌ ‌Teacher‌ ‌Content‌

The‌ ‌terms‌ ‌of‌ ‌this‌ ‌section‌ ‌apply to you if you create content on LEARN Anytime Anywhere as a Teacher ‌(”Teacher‌ ‌Content‌”). Teacher Content may include, without limitation, any articles, videos or other materials submitted to the Site in connection with your Teacher Services.


5.1‌ ‌Teacher‌ ‌Content‌ ‌Ownership

You own the rights to ‌‌your Teacher Content. LEARN Anytime Anywhere does not claim any ‌ownership‌ ‌rights‌ ‌in‌ ‌any‌ ‌Teacher‌ ‌Content you submit to the Site.


5.2‌ ‌Student‌ ‌License‌ ‌to‌ ‌Teacher‌

You‌ ‌hereby‌ ‌grant‌ ‌each‌ ‌Parent/Student‌ ‌who‌ ‌purchases‌ ‌your‌ ‌Teacher‌ ‌Services‌ or Classes ‌a‌ ‌right‌ ‌to‌ ‌use,‌ ‌view‌ ‌and‌ ‌copy‌ ‌your‌ ‌Teacher‌ ‌Content‌ ‌that‌ ‌you‌ ‌use‌ ‌in‌ ‌providing‌ ‌your‌ ‌Teacher‌ ‌Services‌ ‌to‌ ‌such‌ ‌Student‌ ‌solely‌ ‌for‌ ‌personal‌, ‌noncommercial‌ and ‌educational‌ ‌purposes.‌ ‌You‌ ‌acknowledge‌ ‌that‌ ‌all‌ ‌of‌ ‌the‌ ‌representations,‌ ‌warranties,‌ ‌‌license‌ ‌grants‌ ‌and‌ ‌other‌ ‌provisions‌ ‌‌of‌ ‌our Terms and Conditions ‌apply‌ ‌to‌ ‌all‌ ‌of‌ ‌your‌ ‌Teacher‌ ‌Content‌ ‌that‌ ‌you‌ ‌submit‌ ‌to‌ ‌the‌ Site.


5.3‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌License‌ ‌to‌ ‌Teacher‌ ‌Content

In‌ ‌addition‌ ‌to‌ ‌the‌ ‌license‌ ‌you‌ ‌grant‌ ‌to‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌to‌ ‌use,‌ ‌view,‌ ‌copy,‌ ‌modify,‌ ‌distribute,‌ ‌publish, display‌ ‌or ‌otherwise‌ ‌exploit‌ ‌your‌ ‌‌Teacher‌ ‌‌Content ‌of‌ ‌in our Terms and Conditions, ‌you‌ ‌hereby‌ ‌grant‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌a‌ ‌license‌ ‌to‌ ‌use‌ ‌your‌ ‌Teacher‌ ‌Content‌ ‌and‌ ‌information‌ ‌about‌ ‌your‌ ‌Teaching‌ ‌Services‌ ‌in‌ ‌our marketing,‌ ‌advertising‌ ‌and‌ ‌promotion‌ ‌of‌ ‌the Site‌ ‌in‌ ‌any‌ ‌medium now existing or to be developed later.‌ ‌You‌ ‌also‌ ‌grant‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌the‌ ‌right‌ ‌to‌ ‌use‌ ‌your‌ ‌profile‌ ‌name‌ ‌as‌ ‌part‌ ‌of‌ ‌our‌ ‌marketing,‌ ‌advertising‌ ‌and‌ ‌promotion‌ ‌of‌ ‌the‌ Site‌.



6.‌ ‌Prohibitions

In‌ ‌addition‌ ‌to‌ ‌complying‌ ‌with‌ ‌the‌ ‌restrictions‌ ‌regarding‌ the ‌improper‌ ‌use‌ ‌of‌ ‌the‌ Site as described in our Terms and Conditions,‌ ‌you‌ ‌agree‌ ‌not‌ ‌to (‌and‌ ‌will‌ not) ‌assist,‌ ‌encourage ‌or‌ ‌enable‌ ‌Parents/Students‌ ‌or‌ ‌other‌ ‌Teachers‌ ‌to:‌

 

i.      Provide or post false, misleading, inaccurate or plagiarized information on the Site, including in your Teacher profile, course content, lesson history and feedback;

ii.     Fail to establish or maintain your Teacher profile to ensure that it contains complete, accurate and updated information.

iii.   Provide your Teacher Services for free or in exchange for positive feedback or ratings from Students.

iv.    Provide your Teacher Services, including offering and providing lessons, to any "fake" Students that use LEARN Anytime Anywhere Account created by yourself or any third party to drive up your lesson counts and ratings in bad faith.

v.     Forge or alter your background check documentation, education background, curriculum vitae, work experience or certificates.

vi.    Advertise or promote third party language learning services.

vii.  Encourage or allow Students to work with you or accept payment outside of the Site. If a Parent/Student asks you to provide your Teacher Services outside of the Site, please remind the Parent/Student that Classes must be scheduled and paid for through the Site. You can report the Student or contact LEARN Anytime Anywhere customer support.

 

In‌ ‌the‌ ‌event‌ ‌that‌ ‌you‌ ‌violate‌ ‌the‌ ‌prohibitions‌ ‌set‌ ‌forth‌ ‌in‌ ‌this‌ ‌section,‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌reserves‌ ‌the‌ ‌right‌ ‌to‌‌ ‌suspend‌ ‌or‌ ‌deactivate‌ ‌your‌ ‌LEARN‌ Teacher account immediately.‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌also‌ ‌reserves‌ ‌the‌ ‌right‌ ‌to‌ ‌confiscate‌ ‌any‌ ‌earned‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌Credits‌,‌ ‌and‌ ‌you‌ ‌may‌ ‌lose‌ ‌access‌ ‌to‌ ‌your‌ ‌lesson‌ ‌and‌ ‌teaching‌ ‌history‌ ‌on‌ ‌the‌ ‌Site.‌ ‌If‌ ‌you‌ ‌believe‌ ‌that‌ ‌others‌ ‌have‌ ‌violated‌ ‌these‌ ‌prohibitions,‌ ‌or‌ ‌if‌ ‌you‌ ‌are‌ ‌not‌ ‌sure‌ ‌whether‌ ‌any‌ ‌specific‌ ‌actions‌ ‌would‌ ‌violate‌ ‌these‌ ‌prohibitions,‌ ‌please‌ ‌contact‌ ‌LEARN‌ ‌Anytime‌ ‌Anywhere‌ ‌customer‌ ‌support‌ ‌immediately.‌
